Step 3

Failure to address water leakage issues in a unit after receiving Form 28 can result in the owner of the unit being legally responsible. Under the Strata Management Act 2013, there is a statutory presumption that inter-floor leakage originates from the upper floor unit unless proven otherwise by its owner. The owner of the affected area must grant access for inspection within 7 days as mandated by law.

Who should take responsibility for a water leakage problem in a condominium, apartment, or flat unit? Read this article for the right course of action if you’re facing a water leakage from the unit upstairs.

The legal term for this particular problem we’re discussing in this article is “inter-floor leakage” – which is described as water damage to your ceiling. The Strata Management (Maintenance & Management) Regulations 2015 defines this water damage as any evidence of moisture, dampness, or water penetration on your ceiling or the materials that make up your ceiling (Regulation 55).

Inter-floor leakage is particularly difficult to navigate since the root cause of the leakage happens to be in an upstairs unit that belongs to someone else! On top of having to deal with your neighbour above, you may also have to deal with many more stakeholders such as the management of the condominium, contractors, developers, and possibly even legal offices if worse comes to worst.

1. Make an official complaint to the condominium management (CM)

This move applies if you live in a condominium or an apartment that has its own management office. Following the Strata Management (Maintenance and Management Regulation 2015), you have the right to file an official notice to the management of the building to request an inspection. 

The management is then required to perform an inspection within 7 days after you file the notice. They should then issue a certificate of inspection within 5 days after conducting the inspection to identify the cause of the leak and the party responsible for fixing the leakage. If your unit is a new one and is within the defect liability period or still under warranty, you can lodge a complaint to the developer.

2. What if the owner of the unit above refuses to let the management carry out the inspection?

By law, the owner is required to cooperate, or else they could be fined up to RM50,000, jailed for 3 years, or both. In fact, if there is a risk of property damage and/or a likelihood of endangering someone’s life due to the water leakage problem, the management of the building is allowed to enter by force.

3. How soon should the unit owner get contractors to start repairs?

Repair works should start 7 days after the release of the certification of inspection by the management. If the unit owner has failed or refused to fix the water leakage, the management or the joint management body is to immediately take all necessary measures to rectify the inter-floor leakage. They will then charge and recover all costs and expenses from the owner of the unit.

4. From whom do I claim the reimbursement for the damages on my unit?

If you bought a recently developed condominium, SOHO, or apartment unit and it is still under the defect liability period, you can actually make a claim from the developer.

If your unit is no longer covered by the defect liability period, and the damages you have suffered are caused by water leakage from the unit above you, you can claim reimbursements from the owner. Of course – it is easier said than done. Thus, you can claim the reimbursements from the management of the building, and they will then proceed to claim from your neighbour upstairs.

As a property owner, looking for waterproofing fixes can be quite stressful! You might be wondering “How many off days do I have to sacrifice for a full renovation of my leaking bathroom?”, “If I take on a no-hacking service, will it be just as effective?”, or “Which is the best solution for my home, office, or business, really?”

First and foremost, what is the difference between Hacking and No-Hacking waterproofing?

Hacking waterproofing requires the contractor to hammer, or knock at your flooring to fix water leakage issues. The contractor will usually be required to hack out your tiles and failed waterproofing membranes to reapply a new waterproofing solution. Once the solution is fully dried, a new concrete screed is to be applied before the new tiles are laid down on top of it. While hacking methods really do help renew your property’s structural waterproofing, this is a very noisy and dusty process!

Are No-Hacking Required Waterproofing Solutions Reliable?

Looking for a way to fix a waterproofing issue and came across “no-hack solutions”? We applaud the hard work of our fellow experts, but there are still many amateurs in the field that try to promise “cheaper” options. As industry experts, we feel like it’s important to inform you on what you’re in for when you come across epoxy coating waterproofing for your floors.

Smaller, less humid areas are able to dry within 24 hours after project completion, but larger outdoor areas might take 48 hours or more. How do Epoxy floor coatings for waterproofing work?

Epoxy Waterproofing is a waterproofing method that spreads Epoxy chemicals on the floor in a thick liquid state before getting hardened. These Epoxy chemicals include a resin material and a hardener that will then be blow-torched to fuse and create a new air-tight surface that sits on top of the area you want to be waterproofed.

Here are some things you need to know about Epoxy Coating Waterproofing.

1. Emits hazardous and strong smells during and after application.

Once the Epoxy resin and hardener have been mixed and poured on to the floor as a suitable and even layer, the contractor will then proceed to the “curing” phase of the operation. This is where a blowtorch or a heat gun activates and hardens the liquid Epoxy chemicals. Understandably, this causes harmful smells to emit from the working area.

Most contractors are knowledgeable enough to wear proper protective gear while doing their work- but the question is, will you or an at-risk loved one be able to handle the fumes?

2. Epoxy Floor Coatings have a long drying time.

Another factor you have to take into account is how long it would take for the epoxy floor coating to dry. In our experience, the material could take 3-7 days- sometimes even longer to cure because of numerous factors. We should mention at this point that, conventionally, epoxy is reserved for wide surface areas that aren’t visited often. In many cold countries, they are often used in basements.

Epoxy waterproofing requires contractors to pour out and mix Epoxy chemicals with hardeners on the spot.

That’s why we don’t recommend this solution to be done in places you use often, if you don’t have an alternative room for it.

3. Some Epoxy floor coatings have a slippery smooth surface.

More specifically, oil-based resin makes things slippery. Epoxy, as a coating, comes in many forms to serve the different needs of different surface areas. This could range from giving an object a greasy finish to further prevent air from corroding metal surfaces, to providing an enhancing varnishing layer to finish off an artwork. Both could result in a sleek and slippery surface that isn’t the best to walk on if you have weak knees and balancing issues!

When walking on epoxy floors, be mindful of your balance.

4. Some Epoxy dries into a hard and brittle material that scratches easily, depending on the type of solution provided.

There are various epoxy waterproofing coating solutions available that you might not be informed about by your contractors. While it’s best to do your research before getting the help of a contractor on your premise, sometimes amateur contractors might mark up the price of their service for a cheaply made solution that yellows or debonds easily over time. And sometimes, they don’t use the most advanced version of the product that delivers the quality you need to completely stop your water leakage issues.
